Purpose and legal basis for processing:

We may process your personal data for the following purposes and based on the following legal grounds:

  1. in order to implement the obligations incumbent on AIC resulting from applicable legal provisions, including in particular those arising from tax, accounting, customs, anti-money laundering and anti-terrorist financing provisions; 
  2. to pursue our legitimate interests in:
    1. performing the contract that AIC has concluded with the contraotor with whom you are associated as its employee or associate; administering and managing relations with such a contractor
    2. the possibility of contacting you via electronic communication, including placing orders or inquiries, answering questions
    3. ensuring business continuity
    4. pursuing claims or defense against claims submitted against us in accordance with general provisions, in particular the Civil Code
    5. ensuring the organizational security of the AIC plant.
AIC's legitimate interest - balancing test:

Our legitimate interest indicated in points b. i.-iii. above relies on the necessity of processing to ensure the correct performance of the contract concluded with our contractor, to maintain relationship with you and the given contractor, and as a consequence, to conduct our business. We assessed this interest as superior to your rights and freedoms due to the narrow scope of processed data, their professional nature, compliance of the processing with your expectations and very often their public availability.

Our legitimate interest indicated in point b. iv. above is to enable pursuing claims or defend against claims in connection with the performance of a contract with our contractor with whom you are associated. We assessed this interest as superior to your rights and freedoms due to the narrow scope of processed data, their professional nature and very often their public availability.

Our legitimate interest indicated in point b. v. above is to ensure the organizational security of the AIC plant by conducting video surveillance. We assessed this interest as superior to your rights and freedoms in connection with the need to ensure the safety of persons and property in the AIC production plant and the fact of clearly informing you – before you enter the plant - that the AIC production site is covered by the video surveillance.

Objection:

In cases where the legal basis for the processing of your personal data is our legitimate interest, subject to the applicable provisions, you can at any time object to the processing of personal data due to your special situation using the contact details provided above.

Recipients of the data:

Depending on the circumstances, we may disclose your personal data to the following entities:

  1. competent authorities and state services, in particular the Ministry of Finance, other bodies of the National Tax Administration, as well as bodies competent in matters of counteracting money laundering and financing of terrorism;
  2. ​service providers whose services AIC uses when conducting their operations, e.g. companies providing IT, hosting, accounting and tax services, postal and courier services, archiving and utilization of documents services, banks, insurers, law firms and companies providing accommodation services.
Types of data:

AIC will process personal data provided directly by you or the contractor with whom you are associated, and which may include: name, surname, position, place of employment, business contact details (e.g. email address, telephone number), content of correspondence, image recorded through video surveillance carried out to ensure the organizational security of the AIC plant.

Source of data:

AIC has received your data directly from you, from the contractor with whom you are associated or obtained it from publicly available sources, namely the Internet.

Data storage period:

We will store your personal data for the duration of cooperation with the contractor with whom you are associated and for the period of limitation of claims arising from the contract with such contractor, as well as until the expiry of data storage obligations arising from legal provisions, in particular tax and accounting legal provisions, or as long as it is necessary to ensure business continuity.

Your rights:

Subject to applicable legal provisions, you have the following rights in addition to your right to object, as mentioned above:

  • access to data and receiving a copy thereof,
  • requests to rectify personal data,
  • requests to delete personal data,
  • requests to limit the processing of personal data,
  • lodging a complaint to the President of the Office for Personal Data Protection (to the address of the Office for Personal Data Protection, ul. Stawki 2, 00 - 193 Warsaw).

If we have obtained personal data directly from you, we would like to inform you that providing personal data is necessary to achieve the purposes set out above, including possibility of communication with you. Failure to provide certain personal data may result in the inability to establish cooperation or continue such cooperation with the contractor with whom you are associated.
